fa مبانی فلسفی و مستندات قانونی مسئولیت مدنی دولت در بحران کرونا Philosophical Foundations and Legal Documents of the Government's Civil Responsibility in the Corona Crisis تخصصي Special مروري Review Article <div style="text-align: justify;">زمینه و هدف: یکی از مسائل مهمی کـه عـلاوه بـر بعـد فـردی، دارای ابعاد گسترده‌ای در زمینه‌های اجتماعی، حکومتی، امنیتی و رسانه‌ای است، بحران ناشی از همه‌گیری ویروس کرونا است که در این میان، رسالت دولت از اهمیت ویژهای برخوردار است. این پژوهش به دنبال آن است که با بررسی مبانی مختلف فلسفی و مستندات قانونی مسئولیت مدنی دولت، مبنایی مناسب در برابر خسارات ناشی از ویروس کرونا ارائه دهد. روش‌: این تحقیق از نوع نظری بوده، روش تحقیق به‌صورت توصیفی تحلیلی است. روش جمع‌آوری اطلاعات به‌صورت کتابخانه‌ای و با مراجعه به کتاب‌ها و مقالات صورت‌ گرفته است. یافته‌ها: نظریاتی همچون «مصلحت عمومی»، «تضمین حق»، «تضمین مشروعیت»، «تعهدات بیمه‌ای» و «تکافل اجتماعی» مهم‌ترین مبانی فلسفی دولت را تشکیل می‌دهند؛ ضمن آن که مستندات قانونی مسئولیت مدنی دولت در مواجهه با بحران کرونا نیز بر قانون اساسی، قوانین عادی، قوانین ستاد ملی مبارزه با کرونا و قوانین بین‌المللی استوار است. در خصوص این نوع از خسارات، چاره‌ای جز متوسل‌شدن به مبانی فلسفی که به حقوق عمومی و عدالت توزیعی ختم می‌شوند، نخواهیم داشت. نتیجه‌گیری: از اهم نتایج این پژوهش، توجه به راهکارهای جدید در زمینه خسارات غیرقابل‌اجتناب مانند خسارات ناشی از وقوع بلایای طبیعی از قبیل کرونا است. در این راستا، صندوق بیمه همگانی حوادث طبیعی کشور، جزء یکی از نیازهای مهم و الزامی است.</div> <div style="text-align: justify;">Background: Corona virus crisis is an important issue, with numerous dimensions in social, governmental, security and media aspects, in addition to the individual dimension. Among these, the mission of the government is of special importance. This research seeks to provide a suitable basis against the damages caused by the corona virus, via examining various philosophical bases and legal documents of the government's civil responsibility. Methods: This research is theoretical, and the research method is descriptive and analytical. Collection of information is library-based, and achieved by referring to documents, books and articles. Results: Theories such as public interest, guarantee of rights, guarantee of legitimacy, insurance obligations, and social sponsorship comprise the most important philosophical foundations of government legitimacy; In addition, the legal documentation of the government's civil liability in the face of the Corona crisis is based on the Constitution, common law, the rules of the National Anti-Corona Headquarters and international law. With regard to this type of damages, we will have no choice but to resort to philosophical foundations that lead to public law and distributive justice. Conclusion: One of the most important results of this study is to pay attention to new solutions in the field of unavoidable damages, such as damages caused by natural disasters, such as corona.
