fa بررسی نظام حقوقی دارویی ایران از منظر حق بر سلامت Assessment of Iran's Pharmaceutical Legal System from the Perspective of the Consumer’s Right to Health تخصصي Special مروري Review Article زمینه و هدف: امروزه صنعت دارو به عنوان یکی از صنایع کلیدی و راهبرد در جهان مطرح است. دارو به دلیل اثرگذاری بر سلامت انسان‌ها و جوامع بشری همواره از مهم‌ترین ارکان چرخه سلامت بوده است. بر همین اساس همواره تدارک و تأمین داروی مورد نیاز جامعه حتی در بحرانی‌ترین شرایط کشور از اولویت خاص دولت‌هاست. بنابراین، این پرسش پیش می‌آید که آیا حق بر سلامت می‌تواند عامل مهم در پیشبرد نظام حقوقی دارویی و دسترسی به داروی ارزان و با کیفیت باشد؟ هدف مقاله حاضر بررسی نظام حقوقی دارویی ایران از منظر حق بر سلامت جامعه از جمله، دسترسی به داروها و بیان تأثیر حق بر سلامت در تولید، بها و توزیع آن در جامعه می‌باشد. روش: این مطالعه با استفاده از مرور مستندات معتبر داخلی صورت گرفته است. یافته‌ها: فرضیه پژوهش این است که حق بر سلامت می‌تواند به عنوان عامل مؤثری در نظام حقوقی دارویی نقش داشته باشد. دارو و تجارت آن و سلامت رابطه متقابلی با هم دارند، به صورتی که دارو منجر به بهبود وضعیت سلامت و سلامت موجب توسعه می‌شود. حق بر سلامت یکی از مهم‌ترین حقوقی است که در اسناد و معاهدات بین‌المللی و نیز در اسناد داخلی ایران به‌ویژه قانون اساسی و برنامه پنج‌ساله توسعه اقتصادی، اجتماعی و فرهنگی و سند چشم‌انداز بیست‌ساله نظام به رسمیت شناخته شده و مورد تأیید قانون‌گذاران و سیاست‌مداران قرار گرفته است. حق بر سلامت، بخشی از حقوق بنیادین شهروندان در هر جامعه است. هر شهروند به مثابه عضوی از جامعه صرف نظر از ملاحظات نژادی، دینی، سیاسی و فرهنگی صرفاً به واسطه وجود رابطه شهروندی، حق برخورداری از آن را دارا می‌باشد. نتیجه‌گیری: حق بر سلامت می‌تواند یکی از عوامل مهم در پیشبرد و ارتقای کیفیت زندگی و همچنین مؤثر در نظام حقوقی دارویی باشد. اهمیت و توجه دولتمردان و واضعان قوانین و مقررات نظام دارویی می‌تواند نقش مهمی در بهبود سطح سلامت جامعه ایفا نماید، تا بتوانند برای حفاظت از سلامتی مردم و جامعه در برابر آسیب‌های دارویی برنامه‌ریزی مناسبی انجام دهند. Background: Today, the pharmaceutical industry is one of the key industries and strategies in the world. Due to its effect on human health and human societies, medicine has always been one of the most important pillars of healthcare. Accordingly, it is always a special priority of governments to provide and supply the medicine needed by the society, even in the most critical conditions of the country. So the question is, can the right to health be an effective factor in promoting the drug legal system and access to appropriate pricing and quality drugs? The purpose of this paper was to investigate the Iranian pharmaceutical legal system from the perspective of the right to public health, including access to drugs and the impact on health, price and distribution in society. Methods: This study was performed by reviewing credible national documents. Results: The research hypothesis is that the right to health can play an effective role in the pharmaceutical legal system. Medicine its trade and health are interrelated, as the drug improves health and wellness leads to development. The right to health is one of the most important rights recognized in international documents and treaties and domestic documents of Iran, especially the Constitution and the five-year economic, social and cultural development plan and the 20-year vision document of the system recognized and approved by legislators and politicians. The right to health is part of the fundamental rights of citizens in any society. Every citizen, as a member of society, regardless of racial, religious, political or cultural considerations, has the right to benefit from it . Conclusion: ‘The right to health’ can be one of the important factors in promoting and improving the quality of life and also be effective in the legal pharmaceutical system.
